The Real Estate (Regulation and Development) Act was passed by the Indian Parliament in 2016. The RERA was passed by the Indian parliament to protect homebuyers and encourage real estate investment. The Rajya Sabha approved RERA legislation on March 10, 2016, while the Lok Sabha granted its approval on March 15, 2016. The act then came into force from May 1, 2016. The act's 59 sections were notified on May 1, 2016. All remaining provisions became effective on May 1, 2017.
The Act requires that state governments notify their rules under it based on the model rules laid out in the central Act.
What is the RERA? Why was it so important?
For years, home buyers have complained that real estate transactions favor developers and are unfair. RERA and the model code by the government are intended to make it easier for buyers to purchase properties in the primary marketplace. RERA will make it easier to buy real estate by providing more transparency and accountability. The central act's provisions and spirit must be maintained by the states. India's first regulator will be RERA. The Real Estate Act makes it mandatory for each state and union territory, to form its own regulator and frame the rules that will govern the functioning of the regulator.
